Supporting Your Partner’s Studies: Understanding the Spousal Open Work Permit in Canada

Love and education often go hand in hand. If your partner is pursuing higher studies in Canada, you might be wondering what opportunities exist for you to join them. Enter the Spousal Open Work Permit (SOWP), a valuable program that allows spouses and common-law partners of international students to work legally in Canada. This blog explores everything you need to know about the SOWP, from eligibility to application and the freedoms it grants you.

Eligibility for a Spousal Open Work Permit

Great news! As of March 19, 2024, Immigration, Refugees and Citizenship Canada (IRCC) expanded eligibility for the SOWP. You can now apply if your partner is enrolled in a master’s or doctoral degree program at a designated learning institution in Canada. Previously, eligibility was restricted to spouses of PhD students only.

Here’s a breakdown of who can apply for an SOWP:

  • Spouses and common-law partners of international students enrolled in a master’s or doctoral program in Canada.
  • Spouses and common-law partners who are already in Canada on a valid study or work permit and whose partner has applied for permanent residency sponsorship. (Note: You can only apply for an SOWP under spousal sponsorship once you receive an approval in principle letter).

Important Considerations:

  • You cannot be the primary study permit holder yourself.
  • Your partner must be maintaining a full-time course load (defined as at least three courses per semester).
  • You and your partner must meet the requirements for a valid marriage or common-law relationship.

Applying for the Spousal Open Work Permit

The application process for an SOWP can be streamlined if you gather all the necessary documents beforehand. Here’s a checklist to get you started:

  • Completed application form (IMM 5710): Download and fill out the form electronically or on paper.
  • A copy of your valid passport with sufficient validity beyond your intended stay in Canada.
  • Two recent passport-sized photographs meeting specific requirements outlined by IRCC.
  • Proof of your relationship with your partner. This could include marriage certificate, common-law partnership declaration, or other supporting documents.
  • A copy of your partner’s valid study permit and proof of their full-time enrollment at a designated learning institution.
  • Proof of financial resources to support yourself in Canada. This might include bank statements, letters of employment for your partner, or evidence of other financial support.
  • Processing fees: The current fee for an SOWP application is CAD $150. Be sure to check the IRCC website for any updates.

Submitting your Application:

You can submit your SOWP application online through the IRCC website or by mail. For online applications, you’ll need to create a GCKey account, a secure way to interact with the Canadian government online. For mail applications, ensure you use the most recent application kit and follow the instructions carefully.

Processing Time

Processing times for SOWP applications can vary depending on the workload at IRCC. It’s best to check the IRCC website for current estimates. In the meantime, you can consider applying for a visitor visa to allow you to stay in Canada while your SOWP application is being processed.

What a Spousal Open Work Permit Allows You to Do

Once you receive your SOWP, you’ll enjoy the freedom to work legally for any employer in Canada, in any occupation. This means you can pursue your own career goals while supporting your partner’s studies. There are no restrictions on the number of hours you can work, allowing you to tailor your work schedule to your needs.

Additional Benefits

The SOWP offers more than just work authorization. Here are some additional benefits:

  • Gain valuable Canadian work experience: The experience you gain while working on an SOWP can be a major asset when applying for future work permits or permanent residency in Canada.
  • Financial independence: Having an income allows you to contribute to your shared expenses and reduce the financial burden on your partner.
